2024 Amendment Mailout Notice

After careful consideration, we have decided to revisit the process of amending the Deed Restrictions once again. Our initial attempt provided vauable insight, highlighting that voter apathy and awareness were significant hurdles.

With that said, anticipate receiving two proposed amendments (short-term rental and dues increase), along with an informational flyer and ballot in the mail very soon.

It is important to note that the proposed dues increase is now a cap of $.02 per square foot of lot area. The current rate for the annual maintenance charge is a cap of $.01 per square foot of lot area. This proposed adjustment represents a one-cent per square foot of lot area increase, which will still notably contribute to the homes association’s annual operating budget and reserves fund.

The short-term rental amendment (STR) aims to prohibit rentals for durations of less than 31 consecutive days. Shirt-term rentals have been a focal point of discussion during HOA meetings, and a large number of homeowners wanted to see this amendment on the ballot.

Please be informed that by abstaining from voting on the proposed amendments effectively counts as a “no” vote. The dues increase amendment will not become effective unless and until similar amendments are approved by at least 67% of the total number of votes in sections I-VIII within the jurisdiction of NASSAU BAY HOMES ASSOCIATION, INC., it being the intention to assess any increases in the maintenance charge uniformly for all properties sections I-VIII within Nassau Bay (excluding Heritage Townhomes and Queens Court Townhomes).

We encourage you to carefully review and consider each propsoed amendment before casting your vote. Please choose one of the option below to particiapte in the process:

• Fax your ballot to 281-333-3876

The ballot will be open ended and a notice will be sent out 20 days in advance before ballots are due.

Please be informed ballots that are not signed, addressed and dated are not valid. Only one ballot submission per household. If you have any questions about the amendments or would like further information please feel free to contact our office at 281-333-2570. If you do not receive a mailout within the next week please contact the office and they will get you one.
